Janssens & Partners Lawyers: Fees and Expenses Scale
Trust is at the heart of the relationship between the client and his or her lawyer. In terms of the cost of your lawyer’s intervention, this partnership is conveyed by the application of the transparency principle. The information that follows will enable you to understand how the services of your lawyer will be charged.
On this matter, as on all others, your lawyer will always be available to answer any questions that might arise in your specific case.
The lawyer’s fees cover:
- The remuneration of the lawyer’s services themselves (study of documents; consultations; meetings; drafting of correspondence; opinions; writs; court time; pleadings; approaches; telephone conversations, .....)
- A part of the fixed infrastructure costs (real-estate infrastructure, equipment, library, administrative staff, .....)
In Belgium, lawyers’ fees are not laid down by law or by ordinal regulations. They are freely laid down by the lawyer, with due moderation, taking account in particular of the importance of the litigation, its complexity, the degree of urgency, the client’s situation, and the lawyer’s specialisation and experience.
We calculate the lawyer’s fees in several different ways. The most appropriate method for each particular case is defined at the opening of the file, in concertation, with the most frequent being an hourly rate.
1. Hourly Rate
The time devoted by a lawyer to the treatment of the file is scrupulously accounted for, in order then to be invoiced according to a pre-determined hourly rate.
The basic hourly rates are as follows:
- For a trainee lawyer: from €80.
- For a staff lawyer: from €100.
- For a partner lawyer: from €125.
The basic hourly rate that applies to a given file is announced from the opening of that file.
This basic hourly rate can however be increased by a maximum of 100%, for services considered as exceptional and in particular for urgently accomplished duties, for services requiring competence in a specialist subject, on account of the difficulties encountered, the responsibilities to be assumed by the lawyer or the exceptional results obtained.
This basic rate can be decreased, in exceptional circumstances, according to criteria to be considered by the lawyer in charge of the file.
2. Set Price
For certain files comprising few unknown quantities (drafting of a contract, drafting or amendment of articles of association, simple criminal defence,…), we can agree a contractual fee with you.
3. Proportional Fee
For certain cases where the financial stake can be evaluated, it is possible to agree fees calculated by application of a decreasing percentage of the sums recovered or the sums not having to be paid in accordance with the following scale:
As the law prohibits lawyers’ fees from being tied exclusively to the positive result obtained, we also have to agree fees that are due whatever the result obtained. In practise, the fees will be calculated according to the above scale, with a minimum equivalent to the amount calculated according to the hourly rate formula, at the agreed rate.
4. Subscription Agreement
If you entrust our association with a large and regular volume of files, we can agree on special conditions for the calculation of fees for a guaranteed number of hours or files.
5. « Success Fee »
It can be agreed that the fees calculated according to one of the above methods would be increased by a premium of a given amount, according to the result obtained and the interest of that result for the client.
The “success fee” principle, the way of calculating the premium and the conditions of its being granted are determined with you by mutual assent, either at the opening of the file, or at a later date.
The practice requires reimbursement of the expenses that it incurs according to the following scale:

PROVISIONS AND PAYMENTS
With a concern for transparency, and in order to allow you to monitor the ongoing cost of your lawyer’s intervention, you will regularly be asked for provisions on fees and expenses, by mail.
They will cover, as far as possible, the fees and expenses already incurred by the lawyer, and those to be incurred in the near future.
Our activity is essentially based on intellectual and administrative services, the payment of which is required from month to month. Our charges, with regard to our suppliers and our staff, have to be paid immediately.
For this reason, our provision requests and our fee statements are also payable upon receipt.
